Thought Record app terms of use
Effective date: September 30, 2026
These Terms of Use cover the Thought Record app for iPhone and iPad. They are an agreement between you and Everyday Insight LLC, a California limited liability company. Here, “we” and “us” mean Everyday Insight LLC. The mythoughtrecord.com website has its own terms at mythoughtrecord.com/terms.
1. Agreeing to these terms
By accepting these terms in the app, or by using the app, you agree to these terms and to the app’s Privacy Policy, which is part of them. If you don’t agree, please don’t use the app.
2. What Thought Record is
Thought Record is a guided worksheet with educational articles. You describe an upsetting moment, name and rate your feelings, write down the thoughts that went through your mind, weigh the evidence for and against one of them, write a more balanced thought, and note what you learned.
It is a structured way to reflect, for education and personal use.
3. Not therapy, medical care, or crisis support
The app does not provide therapy, counseling, medical care, assessment, diagnosis, treatment, crisis services, or emergency support, and it is not a substitute for care from a qualified professional. It is not a medical device.
Using the app or contacting us does not create a therapist and client relationship, or any other professional or fiduciary relationship, with Everyday Insight LLC or any person. Nothing in the app is advice directed at you or your situation.
If you work with a therapist, psychiatrist, physician, or other clinician, we encourage you to share what you do in the app with them and to follow their guidance where it differs from anything in the app.
4. Using the app at your own risk
Thought records ask you to look closely at moments that upset you. Recalling a difficult situation or examining painful thoughts can bring up sadness, anxiety, shame, anger, or other unwanted feelings, sometimes for a while afterward.
Don’t use the app to work through a traumatic memory on your own, and stop whenever an exercise feels like too much. If the same worry keeps coming back no matter how often you examine it, or if records leave you feeling worse, please talk with a professional.
You alone decide what to write, what to do, and when to stop. You use the app at your own risk. To the fullest extent the law allows, Everyday Insight LLC is not responsible for any discomfort, distress, injury, loss, or other harm arising from your use of the app or from anything you do or don’t do because of it. If a clinician has advised you against something, don’t use the app to do it.
5. If you are in crisis
The app is not a crisis service, and nobody monitors what you write in it.
In an emergency, call 911 or your local emergency number. If you are in crisis in the United States, call or text 988. For Spanish, call 988 and press 2, or text AYUDA to 988.
6. Age
Thought Record is not intended for children under 13. If you are under 18, use it only with the involvement and permission of a parent or legal guardian.
7. Cost
The app is free. It has no subscriptions, in-app purchases, paid features, or ads, and no account is needed.
8. Your license to use the app
We give you a personal, non-exclusive, non-transferable, revocable license to use the app for your own reflection and, if you are a clinician or educator, with the people you work with. We may suspend or end this license if the app is used in breach of these terms.
9. If you are a clinician or educator
You are welcome to use the app in your work. Doing so is your professional decision, and these terms don’t change what you already owe your clients or students.
You remain responsible for your own judgment, for whether this exercise suits a particular person, for your professional, ethical, and licensing obligations, and for any consent a client should give. We have no relationship with your clients and no view into how the app is used.
The app is not a HIPAA-covered service. We are not a business associate, and we won’t enter into a business associate agreement. Don’t use the app to collect, send, or store protected health information for your practice.
10. What you create stays yours
What you write in the app belongs to you. We claim no ownership of it and no license to it. We don’t receive it either, because the app has no accounts and no server of ours. The Privacy Policy explains how the app stores your data.
Because your data is on your device and in your own accounts, keeping it safe is up to you. Deleting the app, losing your device, or removing the synced copy can erase it, and we can’t recover it for you.
11. Methods, sources, and credit
Thought records are a long-established method in cognitive behavioral therapy, taught and published in many versions. Many thought records, including ours, follow the same basic sequence: the situation, your feelings, your thoughts, the evidence on each side, a more balanced thought, and rating your feelings again. The best-known version is the 7-Column Thought Record by Christine A. Padesky, PhD, published in Mind Over Mood by Dennis Greenberger and Christine A. Padesky. The wording, examples, and layout of our worksheet were written for Everyday Insight. The feelings list is adapted from the emotion wheel by Geoffrey Roberts.
Everyday Insight LLC is not affiliated with, sponsored by, or endorsed by Dr. Padesky, Dr. Greenberger, Mind Over Mood, Guilford Press, or Geoffrey Roberts. Mind Over Mood is a registered trademark of its owner, and the name is used here only to cite the book.
12. Our content and using our materials
Everyday Insight LLC or its licensors own the copyright and other rights in the app, its design, code, writing, and examples, and in the layout of the documents it creates. What you write in those documents stays yours. You may use the app and what it exports for yourself and, if you are a clinician or educator, with the people you work with.
You may not sell the app or its materials, charge for access to them, include them in a product you sell, or remove the Everyday Insight name or source credits from copies you share. Any other use needs our written permission, which you can ask for at hello@mythoughtrecord.com.
13. Acceptable use
Don’t copy, resell, or redistribute the app, reverse engineer it except where the law allows, use it to break the law or harm anyone, or try to interfere with it.
14. Sync, app stores, and other services
If you turn on sync, your data is stored in your own iCloud account. iCloud is run by Apple, not by us, and Apple’s terms and privacy policy apply. The app is distributed through the App Store, whose own terms also apply. Links in the app lead to websites we don’t control, and linking to them isn’t an endorsement.
15. Availability and changes
We may change, suspend, or stop any part of the app, including sync and reminders, at any time.
16. Disclaimer of warranties
The app is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and reliability. We don’t promise that the app will be uninterrupted or error-free, or that using it will improve any health or wellness outcome. Some jurisdictions don’t allow certain warranties to be excluded, so some of this may not apply to you.
17. Limitation of liability
To the fullest extent the law allows, Everyday Insight LLC and its owners, employees, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of, or inability to use, the app.
Because the app is free, and to the fullest extent the law allows, our total liability for any claim relating to the app or these terms will not exceed one hundred US dollars. Nothing in these terms limits liability that the law does not allow to be limited, including liability for gross negligence, fraud, or willful misconduct.
18. Indemnification
You agree to indemnify and hold harmless Everyday Insight LLC and its owners, employees, and licensors from claims, damages, liabilities, and expenses, including reasonable attorneys’ fees, arising from your misuse of the app or your violation of these terms or the law. If you use the app with clients, this includes claims brought by them. It doesn’t apply to harm caused by our own misconduct.
19. Governing law and disputes
These terms are governed by the laws of the State of California, without regard to its conflict of laws rules, except where the consumer protection laws of your home jurisdiction provide otherwise.
Before filing a claim, please contact us at hello@mythoughtrecord.com and give us at least 30 days to try to resolve the dispute informally. If we can’t, any dispute arising out of or relating to these terms or the app will be brought only in the state or federal courts located in California, and both you and we consent to their jurisdiction. Either of us may still bring a qualifying claim in small claims court or seek an injunction to protect intellectual property rights.
20. Changes to these terms
We may update these terms. When we do, we’ll post the new version at mythoughtrecord.com/app/terms with a new effective date, and the app will ask you to accept it the next time you open it.
21. Language
These terms are available in English and Spanish. If the two versions differ, the English version controls.
22. General
If any part of these terms is found unenforceable, the rest stays in effect. If we don’t enforce a provision, that isn’t a waiver of it. You may not transfer your rights under these terms. We may transfer ours to a successor, for example if Everyday Insight LLC is sold or reorganized. The sections on not providing care, use at your own risk, what you create, our content, warranties, liability, indemnification, and governing law continue after you stop using the app. These terms and the Privacy Policy are the entire agreement between you and us about the app.
23. Additional terms for the App Store
These apply to the app on iPhone and iPad.
- These terms are between you and Everyday Insight LLC only, not with Apple. We alone are responsible for the app and its content.
- Your license is limited to using the app on Apple-branded products that you own or control, as permitted by the Usage Rules in Apple’s Media Services Terms and Conditions, including use by others in your Family Sharing group where those rules allow it.
- We alone are responsible for any maintenance and support for the app. Apple has no obligation to provide any.
- We alone are responsible for any product warranties. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, which for this free app is zero. To the fullest extent the law allows, Apple has no other warranty obligation for the app.
- We, not Apple, are responsible for any claims relating to the app, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection or privacy law.
- We, not Apple, are responsible for investigating, defending, settling, and discharging any third-party claim that the app infringes intellectual property rights.
- You represent that you are not located in a country subject to a United States government embargo or designated as a terrorist-supporting country, and that you are not on any United States government list of prohibited or restricted parties.
- When you use the app, you must follow any third-party terms that apply to you, such as your wireless carrier’s data agreement.
- Questions, complaints, or claims about the app can be sent to Everyday Insight LLC at hello@mythoughtrecord.com.
- Apple and its subsidiaries are third-party beneficiaries of these terms, and once you accept them, Apple may enforce them against you.
